1. Definitions

For the purposes of these Terms and Conditions:

• “Buyer” means any individual, entity, or organisation that purchases, orders, or receives products from Pure Tide Labs.
• “Products” means any chemical, compound, or substance offered for sale by Pure Tide Labs, including research peptides, reference standards, reagents, and related materials.
• “Research Use Only (RUO)” means that the products are intended exclusively for in-vitro laboratory research and analytical purposes, and not for human or veterinary use, clinical applications, or diagnostic purposes.
• “Misuse” refers to any use of the products inconsistent with these Terms, including human or animal consumption, clinical or diagnostic application, unauthorised distribution, or any unlawful handling.
• “Terms” means this agreement, including all disclaimers, policies, and provisions referenced herein.

2. Legal Disclaimer & Intended Use

All products are not licensed medicines in the United Kingdom, have no marketing authorisation from the MHRA, and are not classified as foods, food supplements, cosmetics, or medical devices. They are sold exclusively for in-vitro laboratory research and analytical purposes.

The following uses are strictly prohibited:

• Human or veterinary consumption of any kind
• Injection, ingestion, inhalation, or topical application
• Use in clinical, therapeutic, or diagnostic contexts
• Compounding, repackaging, or resale as medicines, food supplements, or cosmetics
• Incorporation into medicines, foods, food supplements, cosmetics, or medical devices

These products have not been assessed by the Medicines and Healthcare products Regulatory Agency for safety, efficacy, or any medical use. Misuse may breach the law of the United Kingdom or of other countries. The purchaser assumes all responsibility for compliance with applicable laws and safe handling.

3. Qualified Purchaser Agreement

By purchasing from this website, the Buyer represents, warrants, and certifies that they are at least 18 years of age and are a qualified researcher, scientist, or institutional purchaser capable of safely handling research chemicals.

The Buyer affirms that:

• Purchases are not for personal, recreational, or self-use purposes
• They possess the knowledge, training, and equipment necessary for safe handling, storage, and disposal
• They will comply with all applicable UK and international laws, including the Human Medicines Regulations 2012 and the Control of Substances Hazardous to Health Regulations 2002
• They assume all risks and liabilities arising from handling or use of the products

4. Buyer Assumes Full Responsibility

The Buyer assumes all risks and liabilities associated with the handling, use, storage, and disposal of products.

The Buyer is responsible for:

• Implementing safety and hygiene protocols
• Warning others of potential hazards
• Preventing unauthorised access or misuse
• Ensuring lawful and appropriate use

To the extent permitted by law, the Buyer indemnifies and holds harmless Pure Tide Labs and its affiliates from claims, liabilities, or damages arising from misuse.

5. No Instruction or Usage Guidance Provided

Pure Tide Labs does not provide instructions, protocols, or guidance for dosing, reconstitution, preparation, or application of products. Any enquiries regarding human or animal use will not be answered.

Pure Tide Labs is not responsible for third-party content, including social media, product reviews, or blogs, which may be inaccurate or unlawful.

6. Compliance with Laws

The Buyer must comply with all applicable laws, including:

• The Human Medicines Regulations 2012
• The Misuse of Drugs Act 1971 and the Psychoactive Substances Act 2016, where applicable
• The Control of Substances Hazardous to Health Regulations 2002 and UK REACH
• Local and international chemical safety, import, and export regulations

Products may not be resold, supplied, or exported in breach of applicable laws. The Buyer assumes full responsibility for regulatory compliance.

7. Monitoring & Enforcement Policy

Pure Tide Labs reserves the right, at its discretion, to:

• Cancel or refuse orders if misuse or non-compliance is suspected
• Deny service to any individual or entity
• Cooperate with regulatory or law enforcement authorities

Confirmed misuse may be reported to appropriate authorities.

8. Limitation of Liability

To the fullest extent permitted by law, Pure Tide Labs and its affiliates shall not be liable for any indirect, incidental, or consequential loss arising from:

• Use, handling, or misuse of products
• Failure to comply with these Terms or applicable laws

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under English law. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 where they apply.

To the extent permitted by law, the Buyer agrees to indemnify and hold harmless Pure Tide Labs, its officers, and affiliates from any claims, liabilities, or expenses arising from misuse.

9. Sales Policy, Restrictions & Chargebacks

Pure Tide Labs reserves the right to:

• Restrict, limit, or refuse sales to any customer
• Cancel orders before dispatch, with a full refund of any payment taken
• Enforce policies to ensure compliance with laws and safety standards

The Buyer acknowledges that all sales are subject to these terms, and the company bears no liability for denied or cancelled orders beyond refunding any payment received.

Chargeback Policy

We encourage customers to contact us directly before initiating any payment dispute or chargeback. Most issues can be resolved quickly through our support team without the need for third-party intervention.

If a chargeback is initiated without prior communication, we reserve the right to:

• Provide full transaction, delivery, and communication records to the payment provider
• Dispute the chargeback with supporting evidence
• Restrict or suspend future orders associated with misuse of disputes

We are committed to fair and transparent resolution of all customer concerns and strongly encourage customers to reach out to us first for any issue.

10. Regulatory Status

The products offered by Pure Tide Labs:

• Hold no marketing authorisation from the MHRA and are not licensed medicines for any use
• Are not food supplements within the meaning of the Food Supplements (England) Regulations 2003
• Are not in vitro diagnostic medical devices under the Medical Devices Regulations 2002 and are not offered for any diagnostic purpose
• Are not, to the company’s knowledge, controlled drugs under the Misuse of Drugs Act 1971

All products are labelled and sold as Research Use Only, intended exclusively for in-vitro laboratory research. Nothing on this website is intended as a representation that any product is safe or effective for any use in humans or animals.

11. Intellectual Property

All website content, including text, graphics, logos, images, and code, is owned or licensed by Pure Tide Labs. Unauthorised copying, reproduction, distribution, or commercial use is prohibited without written consent.

12. Privacy & Data Collection

We collect and use personal data, including email communications, delivery information, and order data, in accordance with our Privacy Policy and UK data protection law.

We do not sell or share personal information with third parties except as required by law or as necessary to fulfil an order.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that a consumer resident in Scotland or Northern Ireland may also bring proceedings in their local courts.

14. Miscellaneous

• Severability: If any part of these Terms is unenforceable, the remainder remains in effect.
• Force Majeure: Pure Tide Labs is not liable for delays caused by circumstances beyond its reasonable control.
• Amendments: Terms may be updated at any time. The version in force when you place an order applies to that order.
• Acceptance: Purchase or use of the website constitutes agreement to all Terms.
